Terms of Use

Burnish is operated by Silk Creative Labs LLC, a California limited liability company doing business as Burnish ("Burnish", "we", "us"). By using the Burnish iPhone app or the website at burnishaudio.com, you agree to these terms. If you do not agree, do not use Burnish.

The service

Burnish analyzes audio, repairs common problems it detects, and masters the track toward a streaming loudness target. On the iPhone app this all runs on your device. On the website you upload a file and we process it and return a master. Every master ships with its measured report so you can judge the result yourself.

Purchases

iPhone app. The first master is free. After that, a single one-time in-app purchase unlocks unlimited mastering. It is not a subscription, and it does not expire. The purchase is sold and processed by Apple through the App Store, and Apple's terms and refund policy apply. Refund requests for the app are handled by Apple, not by us.

Website. Analysis and previews are free. Downloading a finished master requires a credit. Credits are sold through Gumroad, which acts as the merchant of record and handles checkout, cards, and applicable sales tax. One credit unlocks one master, credits do not expire, and because a credit delivers a digital good the moment it unlocks a download, credits and unlocked downloads are non-refundable except where a refund is required by law or granted under Gumroad's policies.

Your content and your rights

You keep all rights to the audio you process with Burnish. On the app, nothing is uploaded. On the website, you grant us only the limited permission needed to process your file and return a master to you. You are responsible for holding the rights to any audio you use, and you agree not to process material that is unlawful or that infringes anyone's rights. We do not use your audio to train models, and we do not sell it. See our Privacy Policy for how we handle data.

Acceptable use

Do not attempt to break, overload, or gain unauthorized access to the service, and do not use it to process content you have no right to use.

No warranty

Burnish is provided as is. Mastering is a creative and technical process, and we do not warrant that a given result will meet your expectations or any distributor's requirements. Every master ships with its measured report so you can judge the result yourself before relying on it.

Limitation of liability

To the fullest extent allowed by law, Silk Creative Labs LLC is not liable for any indirect or consequential damages arising from your use of the service, and our total liability for any claim is limited to the amount you paid us, or to Apple for the app, in the twelve months before the claim.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

Changes

We may update these terms. Material changes will be reflected in the date above, and continued use after a change means you accept the update.
